This introduction is by way of attempting to provide your Honors with an accurate overview of the circumstances and events of the past four years which has led me to conclude that the Commonwealth of Massachusetts, through a series of mishandled actions and inaction’s, has been and is conflicted from rendering any fair and impartial justice to Esther Johnson, her heirs and relatives, or her estate. I do not intend to imply or state that the agencies of the Commonwealth did from the outset, intend to usurp the constitutional rights of one of its citizens, but through a series of blunders and mid-level mismanagement’s did allow this condition to occur and thus created the circumstance which led to the wrongful death of a senior citizen, one Esther Johnson.

The following list of events and actions by the Commonwealth and the documented efforts attempted by the family, friends and heirs of Esther Johnson to restore her constitutional , civil and human rights is not, nor is it an attempt to have the Federal Court overturn State Court Rulings but is merely presented to your Honors to point out the rational behind this pro-se litigants actions.

The principal persons who perpetrated this Kidnapping by Pretense Under Cover of Law are well connected in the Commonwealth of Massachusetts, i.e. William Brisk (Council on Elder Law), David Aptaker (Council to A.G.), Adrian Knudsen (D.S.S.) Subcontractor, R.N. Harriet Johnson Moore (D.S.S. Expert Witness), Andrea Natsios (D.S.S.), Valerie Jacoby (D.S.S.), R.N. Geraldine Foley (D.S.S.) (Waltham Police).

By acting in unison and each participant supporting the other person’s fictitious presentations, they presented the Probate Court with a plausible scenario, which without examination, effectively blind-sided the Probate Judge. As the evidence against this group began to accumulate, they successfully blocked it from coming to the attention of the Judges. When Harriet Johnson Moore’s eldest son Francis Shadrawy informed the Chief of Police of Waltham of the pre-meditation of the attack which was occurring to his grandmother, Harriet Johnson Moore, in fear of losing the Guardianship, attempted to kill her mother and place her friend Andrea Natsios in position as Administrator of the estate. The first three murder attempts were thwarted by interventions, 1) Aug 13, 1995, E.M.T., 2) Aug 28, 1995, W.V.N.A., 3) Oct 19, 1995, E.M.T. and Deaconess Glover Hospital.

These first three attempts cannot be explained away by error, neglect, or misunderstanding as the eye witnesses and the medical records, already seen by Dr. Silvia Comparini, effectively dissolve all of these possibilities.

At a motion hearing May 23, 1997 held before Judge Judith Dilday at the Cambridge Probate Court, the issue of harassment and barbarous behaviors inflicted upon the Ward, her family and friends was raised. I questioned why the court was allowing this travesty to be ongoing. Judge Dilday's response was, "Well, you have made serious accusations against people that we know and deal with on a daily basis!". My response was, "Yes and I've done so under oath and you can file perjury charges against me".

In outlining the following events in chronological order, I will indicate by pound signs the availability of evidentiary back-up exhibits. One # indicates eye witnesses (all eyewitnesses, family, friends and heirs have indicated to Commonwealth of Massachusetts representatives, their willingness to undergo polygraph exams). Two ## indicates the addition of photographic, tape recordings and signed correspondence. Three ### adds medical records, police reports and statements of professionals, i.e., Social workers, Registered Nurses and Doctors.

The # sign designations which appear to each statement of fact indicate evidentiary materials already in hand which can be made available to Your Honors upon request and each # designation is hereby made under the Pains and Penalties of Perjury
